Civil society leaders in South Sudan are closely watching a legal battle unfolding in Sweden, as prosecutors investigate an oil company accused of involvement in massive human rights abuses here.

James Ninrew vividly remembers the day Sudan’s military attacked his community, which had the misfortune of living above vast oil reserves consigned to a consortium led by the Swedish oil giant, Lundin Oil.

“They used helicopter gunships to bomb houses,” the reverend and civil society leader recalled of the January 2000 attack, in Koch, Unity state. An elderly man and his wife were killed in the attack. “When the houses were on fire, the helicopter gunship landed and the soldiers came out and shot these people.”

Such accusations form part of the basis of a report that has recently prompted Sweden’s public prosecutor, Magnus Elving, to launch an investigation that could lead to a criminal case against Lundin Oil.

The 2010 report by the European Coalition on Oil in Sudan (ECOS) alleges that Lundin may be culpable for atrocities committed against civilians by military and militia forces in areas where it operated. Lundin headed a consortium that included Malaysian, Sudanese and Austrian companies, which signed an oil contract with the government in 1997.

“The start of oil exploitation set off a vicious war in the area,” according to the report, which says almost 200,000 people were forced from their land and thousands were killed, while other crimes included arson, looting, rape and torture.

“The forced displacement was motivated by the desire to secure oil fields for the purpose of exploitation,” said ECOS. The report called on Sweden, Austria and Malaysia to investigate whether the companies “may have been complicit in the commission of war crimes and crimes against humanity.” Although Elving has not named Lundin as the subject of his investigation, he has stated publicly that it was prompted by the ECOS report. Prosecutors have begun interviewing 40 people who have not been named.


Carl Bildt

At the time of the alleged crimes, Lundin’s board of directors included Sweden’s current foreign minister, Carl Bildt. Elving has told Swedish media that Bildt is not among the 40, but refused to comment on whether he could be questioned later in the investigation.

Lundin has repeatedly rejected allegations made by ECOS. “There is no new evidence in this report; it essentially reiterates inferences, insinuations and false allegations based on partisan and misleading information,” Ian Lundin, chair of the board of directors wrote in a letter to shareholders after the release of the report.

In 2003, Lundin commissioned a paper to refute allegations that it had been involved in human rights abuses.

The paper pointed out that Lundin consulted community leaders as well as local and central government officials before undertaking operations. The company determined that an oil industry would be of benefit to local communities, and it spent 1.7 million dollars in three years on development projects.

Kathelijne Schenkel of ECOS said in an interview that most of those consulted by Lundin were in fact “important military-political leaders in the area who at the time were allies of the Government in Khartoum.” She called the 1.7 million dollars Lundin spent on development a “ridiculous sum” compared to the damages it brought to the area.

“Lundin sold its stake in 2003 at 142.5 million dollars, cashing in on a 100 million dollars net profit,” said Schenkel.

Lundin has argued that it operated under the assumption that oil wealth could help bring peace to a country that was in the midst of a two-decade civil war, which ended in 2005 and led to South Sudan declaring independence this past July.

“During the period in which the company was active in Sudan, it operated in the belief that oil could benefit the economic development of the area and the country as a whole, and that this would have a catalysing effect on the peace process,” wrote Christine Batruch in the 2003 paper produced by Lundin.

ECOS rejected the argument that the company could have been ignorant of the massive human rights abuses that accompanied that start of oil operations. The report points out that Lundin had been involved in the oil business in Sudan for six years before it signed a deal with the government to explore the area known as Block 5A. By that time the government had a brutal reputation for targeting civilians “as a means of warfare and to secure oil operations”.

Ninrew said the brutal and systematic nature of the government’s operations in advance of the oil industry was obvious to anyone in the area. The government would begin by indiscriminant bombing, driving many from their homes. This would be followed by helicopter gunships flying low in order to attack those that remained.

“The third step was sending ground troops coming in vehicles and coming on foot to make sure no more people were there,” said Ninrew.

Soldiers would then establish posts just beyond the area they wanted to control, he said. After that, the machinery and the surveyors would arrive. Once they were done their work, the pattern would be repeated as the oil company expanded into territory falling under its concession.

Ninrew said he hopes the investigation in Sweden will lead to a criminal case, although he pointed out that it would not necessarily mean compensation. He said the Swedish government should pressure Lundin to compensate affected communities by building schools, clinics and roads.

Ninrew said that even if compensation is not forthcoming, a criminal case against Lundin could have the benefit of preventing future abuses.

“It may serve as a lesson to other companies that want to come to South Sudan and other countries in Africa,” he said. “We want to put an end to those oil companies coming to an area and doing whatever they like without the consent of the local people living in the place.”

Thiel is probably the valley's most prominent libertarian (sorry, T.J.), a PayPal co-founder who had the good sense to loan Mark Zuckerberg a half-million dollars as he was starting Facebook. Thiel later converted it to a 7 percent share of the company.

The 44-year-old entrepreneur takes his faith further than most libertarians in the valley. The Packer piece, which you can read at www.newyorker.com, has a hilarious anecdote about Thiel oscillating on whether to wear a seat belt or not. (On balance, he agrees it's probably a good thing.)

I disagree with Thiel on many things. But on one subject, a sacred cow in America, I find myself in accord -- the need for sweeping change in our higher education system.

Thiel carries the argument with his customary ruthlessness. He is convinced that higher education is our next bubble. He has likened university administrators to subprime mortgage brokers who saddle students with debt that even bankruptcy can't end.

His primary point -- one I agree with -- is that entrepreneurship is rarely taught in the academy. Instead, the pursuit of a college degree is an expensive quest for status, an insurance policy unrelated to its real benefits for society.

To remedy this, Thiel
has announced the award of the Thiel Fellowships -- 22 grants of $100,000 each to people under the age of 20 who agree to forsake college to begin their own startups.

"No small part of his goal was to poke a stick in the eye of the top universities and steal away some of their best," Packer writes.

Over the years, I've occasionally loudly declaimed at parties that if I knew I wanted to be a journalist from the start, I would have skipped college.

Instead, I would have persuaded my parents to send me to a better high school and then have spent a year or two learning another language and the rudiments of computers.

My wife rolls her eyes at this. But my point, and I think Thiel would share it, is that we have made a college degree the entrance ticket to a good job, when it often bears little relevance to what we do.

Certainly college offers other benefits -- the opportunity to think critically, to expand our horizons, to meet people from different backgrounds. But many students are there primarily because they don't want to risk failure.

It's precisely risk that we should be encouraging, the willingness to start a venture even when the odds seem long. We should be teaching young people that failure is like rain: Eventually, you'll dry off. You won't die. You won't starve. "Mark, you're not going back to Harvard," Sean Parker told the Facebook founder in 2004.

While you can criticize the Thiel Fellowships because they are intended for the elite, risk doesn't need to be the province of Silicon Valley.

Risk is present when someone starts a vacuum repair company, a landscaping firm or a cookie shop. It's what has powered American history. It needs to again.

Sutherland should have been told of Gadafy claims - report

FORMER CHAIRMAN of BP, Peter Sutherland, should have been told of untruthful claims by a son of Col Gadafy that part of a £1.5 million donation he offered to the London School of Economics was being funded by the petroleum company, an inquiry found.

The inquiry into the donation controversy, which forced the resignation of the LSE’s director, Sir Howard Davies, found no evidence that the company, then chaired by Mr Sutherland, knew anything of the donation offered by Saif al-Islam.

In his report, Lord Harry Woolf, said it was “a matter of particular regret” that Mr Sutherland, who also chairs the LSE’s governing council, was not told by LSE staff about the BP claim before a decision was made by the council to accept the money.

“Peter Sutherland, at the time both chairman of LSE’s council and chairman of BP, was not told that BP had been cited as a sponsor of the gift.

“He was not aware BP had been cited by Saif as a source until I told him so in interview,” said Lord Woolf.

“That is a matter of particular regret since, had Peter Sutherland known, he could have told council of the inherent unlikelihood that BP would ever make a donation to the LSE through the conduit of Saif Gadafy’s foundation,” said the former judge.

Lord Woolf said the efforts of LSE executives to develop links with the now-ousted Libyan regime “have clearly brought to light shortcomings in communication and governance within the LSE” and sharply questioned the role played by the former director of the LSE, Sir Howard Davies.

Ties between the LSE and Libya developed significantly after November 2001 until February this year, after Saif al-Islam came to study for an MSc. He later went on to do a PhD – even though there were doubts at the time about his abilities and even fears that he had sent someone to sit an exam for him.

During long-running talks with Mr Davies, who resigned in the wake of controversy about the offer, Saif al-Islam claimed the money would come from his charitable donation from payments made to it by BP, British Gas and Shell, though none of the companies had, in fact, done so.

The acceptance of the first part of the gift, which subsequently sparked protests at the LSE, was approved at its council’s June 2009 meeting, but the council was not told which three companies were to support the gift.

Mr Sutherland declared “what might be considered a conflict of interest” at the June meeting because of BP’s existing commercial interests in Libya – not because of the donation – and did not take part in discussions about the offer, although he was present.

The discussion at the meeting had centred on whether the LSE should deepen ties with the Libyan regime, and not on the source of the donations, said Lord Woolf, who quoted Mr Sutherland as saying that “every effort was being made to help Libya, so why should we resist and not take a donation, rather than it being a discussion about whether we received money”. However, the judge said that while the LSE’s council had “ultimate responsibility for the acceptance or refusal of gifts” it did not mean that that should be part of its day-to-day work because “the council is not suited to perform this task”.

“As Peter Sutherland described to me, it is clear that a body of 32 members cannot be used as a management tool. It is a body charged with making important decisions of principle,” he said.

The chairman of one of the world’s largest pharmaceutical companies will discuss humanity, business and ethics at the Wake Forest Schools of Business as part of the Broyhill Leading Out Loud Executive Lecture Series.

Dr. Daniel Vasella will address the challenges and opportunities facing the global pharmaceutical industry and answer the question “how can businesses be caring?” during a on Thursday, Dec. 1, at 3:30 p.m. in the Worrell Professional Center Auditorium, Room 1312 on the Wake Forest University campus.

Vasella is the chairman of Novartis AG. He served as CEO and executive member of the board for 14 years following the merger that created Novartis in 1996. He was named chairman in April 1999.
